Welcome to NXT-SHIFT Media. By accessing our website or purchasing any of our services, you agree to the following Terms & Conditions. Please read them carefully.

1. Services Overview

NXT-SHIFT Media provides creative services including, but not limited to:

  • Graphic design (digital and print)

  • Photography and videography

  • Video editing

  • Website design and maintenance

  • Social media content and strategy

  • Event and tournament media coverage

  • Recruiting media packages

 

Service pricing and deliverables are outlined on our website and may vary based on scope, customization, and turnaround time.

2. Payments & Billing

2.1 Payment Terms

  • Full payment or deposit may be required prior to the start of any project.

  • Subscription services are billed monthly.

  • Custom projects may require milestone-based payments.

2.2 Late Payments

  • Late payments may result in paused services or delayed delivery.

  • NXT-SHIFT Media reserves the right to withhold final deliverables until payment is received in full.

2.3 Refund Policy

  • Due to the custom nature of our work, all sales are final unless otherwise agreed upon in writing.

  • Deposits are non-refundable once work has begun.

 

3. Revisions & Scope of Work

  • Each service includes a limited number of revisions based on the project type.

  • Additional revisions or changes outside the agreed scope may result in additional fees.

  • Turnaround times may be extended if revisions exceed the original scope.

 

4. Client Responsibilities

Clients agree to:

  • Provide all necessary content (logos, photos, information, etc.) in a timely manner

  • Communicate clearly and respond to requests promptly

  • Ensure they have the rights to any materials provided to NXT-SHIFT Media

Delays in communication or content delivery may impact timelines.

 

5. Intellectual Property

5.1 Ownership

  • Final deliverables are owned by the client upon full payment.

  • NXT-SHIFT Media retains the right to display work in portfolios, marketing materials, and social media.

5.2 Usage Restrictions

  • Clients may not resell, redistribute, or modify deliverables for resale without written permission.

 

6. Event Coverage & Media Sales

6.1 Coverage Terms

  • Event coverage (games, tournaments, media days) is subject to scheduling, staffing, and availability.

  • Deliverables may vary depending on event size, conditions, and agreed package.

6.2 Public Sales Model

  • At certain events, NXT-SHIFT Media operates as a vendor, selling photo and video content directly to attendees.

  • Revenue from these events may vary based on attendance and demand .

6.3 Turnaround Time

  • Standard delivery timelines apply unless expedited services are agreed upon.

 

7. Cancellations & Rescheduling

  • Cancellations must be made at least 48 hours in advance when possible.

  • Deposits for scheduled shoots or events may be forfeited if canceled without notice.

  • Rescheduling is subject to availability.

 

8. Limitation of Liability

NXT-SHIFT Media is not liable for:

  • Delays caused by client communication or third parties

  • Loss of content due to unforeseen technical issues (though backups are maintained when possible)

  • External factors affecting event coverage (weather, venue restrictions, etc.)

 

9. Website & Digital Services

  • Website builds and maintenance are provided based on agreed scope and pricing.

  • Ongoing maintenance requires an active subscription or agreement.

  • NXT-SHIFT Media is not responsible for third-party platform outages (Wix, hosting providers, etc.).

 

10. Termination of Services

NXT-SHIFT Media reserves the right to terminate services if:

  • Terms are violated

  • Payments are not fulfilled

  • Communication becomes unprofessional or abusive

 

11. Modifications to Terms

We reserve the right to update these Terms & Conditions at any time. Continued use of our services constitutes acceptance of any changes.
